Digital Millennium Copyright Act

TEC is committed to compliance with U.S. copyright law and expects all end users, both those who access some of our Services but do not have accounts (“Visitors”) as well as those who pay a monthly service fee to subscribe to the Service (“Customers”), who access our Services to do the same. TEC reserves the right to permanently terminate access for users who are repeat infringers.

The Digital Millennium Copyright Act of 1998 (”DMCA”) provides recourse for owners of copyrighted material who believe that their rights under U.S. copyright law have been infringed on the Internet. Under the DMCA, copyright owners may contact the authorized agent of an Internet service provider to report alleged infringements of their protected works hosted on the service provider’s network. Upon receipt of a properly filed complaint that satisfies DCMA requirements, TEC will promptly remove or block access to the allegedly infringing material, including suspending or terminating the underlying account.

If a Customer or user of the TEC service believes in good faith that a notice of copyright infringement has been wrongly filed, such person may submit a counter notice to TEC. TEC will not be a party to disputes over alleged copyright infringement.

If you believe that your copyrights have been infringed, or if a notice of copyright infringement has been filed against you, we advise that you seek legal counsel. Notification of Claimed Copyright Infringement

If you believe that content hosted by TEC violates your rights under U.S. copyright law, you may file a copyright infringement complaint with TEC’s designated agent in the manner described below.

For your complaint to be valid under the DMCA, you must provide the following information when providing notice of the claimed copyright infringement:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing or to be the subject of the infringing activity and that is to be removed or access to which is to be disabled as well as information reasonably sufficient to permit TEC to locate the material.
  4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

You should be aware that, under the DCMA, claimants who make misrepresentations concerning copyright infringement may be liable for damages incurred as a result of the removal or blocking of the material, court costs, and attorneys fees.

Counter Notification to Claimed Copyright Infringement

If a notice of copyright infringement has been filed against you, you may file a counter notification with TEC’s designated agent at the address listed above. Such counter notification must contain the following information:

  1. Physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that the Customer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the federal district in which you are located, and that you will accept service of process from the complainant.
If TEC receives a valid counter notification, the DMCA provides specific guidelines by which the removed material may be restored or access re-enabled.

Please be advised that U.S. copyright law provides substantial penalties for a false counter notice filed in response to a notice of copyright infringement.

Fair Access Policy

At TEC, our goal is to meet the needs and exceed the expectations of our Customers. We are always striving to develop programs and policies that help make that possible. This Fair Access Policy is designed to help maximize efficiency of TEC’s Broadband Services ensuring the most valuable Service for the vast majority of our customers.

TEC estimates a small percent of customers account for a disproportionate share of data usage on the TEC network. To ensure that all TEC customers have equitable access to the TEC network, TEC has implemented a Fair Access Policy (or “FAP”). TEC sets usage thresholds on the amount of data you can upload and download within stated time periods. If you exceed these thresholds, TEC will temporarily limit the speed at which you can send and receive data over the TEC access network. You will still be able to access the TEC Broadband Services but your speed will be slower. In cases of extreme and continued violation of the FAP limitations, your service may be suspended. TEC may use other traffic management and prioritization tools to help ensure equitable access to the TEC network for all customers. Your TEC Broadband Services access is not guaranteed and is subject to this FAP.

Based on an analysis of typical customers, we have set a monthly limit on data usage per customer, called a monthly Usage Threshold. As shown in the table below, this threshold varies based on the service plan you selected. For each service plan, the Usage Thresholds are significantly above the amount of data that is used by a typical customer. We measure your upload and download data usage (“Actual Usage”) to determine if your actual data usage in any calendar month exceeds the Usage Threshold for the service plan that you selected.

If at any time during a calendar month your Actual Usage is above the monthly Usage Threshold, we may, at our sole discretion, reduce your TEC access speeds for the remainder of the calendar month. At the beginning of the next calendar month, you will be restored to your original speed levels.

You are likely to avoid any limitations imposed by the FAP if your use is typical of the majority of Broadband Services users and consists primarily of Web surfing and a reasonable amount of downloading. The table below shows the monthly FAP limits for each plan. These limits specify the amount of data that you can upload and download before your access speed is reduced. Please note that your Actual Usage is far more likely to exceed the FAP limits below if you use peer-to-peer file sharing programs, you use a webcam or you download full length movies, large quantities of music files, full software applications or similar high-bandwidth activities.

These terms and conditions state important requirements regarding your use of TEC’s Broadband Services and your relationship with TEC. You should read them carefully as they contain important information regarding your rights and ours. If you do not agree to these terms and conditions, you many not use the Service and, subject to the terms of your Broadband Services Agreement, you must terminate your Service immediately.

Mileage = In determining the mileage associated with the above-referenced mileage bands, the distance between the originating dialing location to the recipient’s called location is measured on the basis of airline mileage between the rate centers of the two stations involved.
A rate center is a specific geographical location identified and used for the purpose of determining these mileage measurements.

CPNI


What is CPNI?

Customer Proprietary Network Information, or “CPNI”, is information that TEC obtains when we provide telecommunications services to you. This information includes the type, technical arrangement, quantity, destination and amount of use of these telecommunications services and the related billing information for these services. As a customer of our services, you have the right, and TEC has a duty under federal law, to protect the confidentiality of your CPNI.

Use and Disclosure of CPNI

We use CPNI to provide telecommunications services to you, including billing and collections for those services, and to offer you services of the type you already purchase from us. With your permission, we use your CPNI to offer you the full range of products and services offered by the TEC family of companies. Services offered by the TEC family of companies include local telephone service, long distance, dial up and high speed internet services, VoIP, broadband and network services, cable TV and security systems. TEC abides by federal and state CPNI regulations that apply to telecommunications carriers. As a general rule, TEC does not disclose CPNI to unaffiliated third parties without your permission. However, we do release CPNI if TEC is required to disclose such information by law or to protect the safety of our customers, employees or property. If you wish, you may direct TEC to refrain from using your CPNI for marketing purposes. To do so, you may contact a customer care representative at the division in which your service is registered. Restricting our use of your CPNI will not affect the provision of any TEC services or products which you have purchased.

Lifeline

Lifeline is a government assistance program that offers qualified, low-income customers in limited geographic areas a discount on their monthly phone bill. Lifeline assistance is only available for one phone line per household. Data services, Text Messaging and other enhanced services or features, international long distance and access to “900” numbers are not available to Lifeline customers. Other restrictions may apply.
